mindburp’s personal data policy

The purpose of this personal data policy is to provide a general description of how Burp Empire AB (“Burp Empire” or “we”) processes personal data for visitors to www.mindburp.se (the “website”) and/or are registered users of the mindburp app, which is accessed via app.mindburp.se (“mindburp”).

Burp Empire undertakes to respect and protect your personal data and your privacy in accordance with the General Data Protection Regulation (GDPR) and other applicable privacy legislation. We are transparent about how we process personal data and it is important for us to respect and safeguard an individuals’ right to privacy.

You may contact us at any time if you have any questions about your personal data or this personal data policy by e-mailing us at support@mindburp.se. The information provided here is general and in many cases more specific information is provided in an agreement or in another context which, in that case, must apply in addition to and, as appropriate, with amendment of the information provided below.

Collection of information

General

Burp Empire is the personal data controller for the processing of personal data with which you provide us via the website by contacting us or when you register and use the mindburp app.

On the website, you are able to provide information about your name, details of how you can be contacted, company name and you can send a message in which you yourself choose what information you want to provide. Take care not to provide sensitive personal data.

We also use Local Storage to handle log-in and sessions. For more information on how we process your personal data using Local Storage, please read our Local Storage policy, here.

For mindburp users, we process personal data such as username, e-mail address and selected password as well as information you provide about yourself or others in the app. If you subscribe to the paid version of mindburp, we also receive information about the business transaction and if you choose to pay by credit card, we receive information about your payment.

Visitor to the website or person making contact with Burp Empire

Purpose:

Burp Empire processes your personal data to provide a high level of service to those who have contacted Burp Empire with questions, comments or in connection with any other matters.

The legal basis for processing your personal data is established according to a balancing of interests in which we consider that Burp Empire’s interest in being able to provide a high level of service in the case of correspondence or other matters and in you having your case dealt with and having your questions answered when you contact Burp Empire outweighs your right not to have your personal data processed.

Services and users of the mindburp app (companies and private individuals)

Purpose:

Burp Empire processes personal data belonging to users to enable it to provide users with services and the mindburp app. Burp Empire also processes contact information for marketing purposes in order to manage the customer relationship and to provide support.

For the purposes to enhance security for users your e-mail address will be presented to other users of the mindburp app that you collaborate with.

Users are able to change their settings in the app to receive e-mails containing reminders and newsletters. E-mail mailings containing reminders are sent to remind the user of important events, future activities and updates. Newsletters are sent out for the purpose of providing information and news about activities and the app, as well as for marketing purposes.

Processing of personal data belonging to users or potential users who are private individuals is necessary in order to fulfil an agreement to which the user is a party or to take action at the request of the data subject before such an agreement is entered into.

When processing personal data belonging to a user where a company has entered into an agreement regarding mindburp, the processing is carried out when it necessary for purposes relating to Burp Empire’s legitimate interest where we consider that Burp Empire’s interest in being allowed to process the personal data outweighs the user’s right not to have his or her personal data processed.

For processing carried out for the purpose of providing reminders and newsletters to users and for marketing purposes, the processing takes place when it is necessary for purposes relating to Burp Empire’s legitimate interest where we consider that Burp Empire’s interest in being allowed to process the personal data outweighs the user’s right not to have his or her personal data processed.

Recipients of your personal data

Burp Empire will not sell or disclose your personal data to any other company for marketing purposes. If suppliers or partners process your personal data on behalf of Burp Empire, Burp Empire will enter into an agreement with those suppliers and partners in order to ensure a high level of protection and proper processing of your personal data.

Data and minimisation of storage

Burp Empire does not collect more information than is necessary for the fulfilment of the purpose for which the personal data is collected. That means that we only request personal data that is necessary for our business activities.

Burp Empire saves personal data for as long as is required in view of the purpose of the processing, unless the data is required by law to be stored for a longer period. Personal data in a collaboration or customer or supplier relationship is not saved for more than one year after the collaboration or customer or supplier relationship has ceased.

In the case of e-mail, continuous thinning takes place and e-mail messages that are no longer necessary for Burp Empire’s business activities are deleted.

Transfer to a third country

Your personal data may be processed outside the EU/EEA by our supplier in the case of e-mail mailings and text messages. Otherwise, your personal data is processed within the EU/EEA.

Burp Empire takes all reasonable legal, technical and organisational action to ensure that your data is processed securely and with an adequate level of protection comparable to and at the same level as the protection provided within the EU/EEA. This has been done in the most appropriate way by certification of the supplier according to Privacy Shield.

Your rights as a data subject

Burp Empire endeavours to ensure that all the information we process is accurate. This naturally also applies to the personal data we collect. You may at any time request information on the data that Burp Empire processes on you and request that your data be corrected or supplemented if it proves to be inaccurate or incomplete.

Under certain conditions and in accordance with applicable legislation, you are also entitled to (i) request that your data be deleted, (ii) request that the processing of your personal data be restricted, (iii) object to the processing of your personal data, including specifying that it must not be processed or used for direct marketing or analytical purposes (including profiling, if it is linked to direct marketing), and (iv) request that your personal data be transferred to you or to another person in a electronic format.

If you object to any processing, Burp Empire is no longer permitted to process the personal data unless we have a legal basis other than balancing of interests or are able to demonstrate conclusive legitimate reasons for the processing which outweigh the interests, rights and freedoms of a data subject or if its purpose is to establish, process or defend legal claims. If your objection relates to processing for direct marketing, Burp Empire is no longer permitted to process the data for that purpose (unless we have a basis for processing other than according to a balancing of interests). Burp Empire is not then entitled to continue with the processing in question (unless there is another legal basis for the processing). In Sweden, the relevant supervisory authority is the Swedish Data Protection Authority. As a data subject, you can contact the Swedish Data Protection Authority if you consider that Burp Empire is processing your personal data incorrectly or if you receive a message from us that you do not agree to and that relates to the processing of your personal data.
